CONSTITUTIONS AND FUNCTIONS OF AFRC

Admission and Fee Regulatory Committee is a statutory body with quasi judicial power, constituted under Madhya Pradesh Act 21 of 2007 of Madhya Pradesh Niji Vyavsayik Shikshan Sanstha (Pravesh Ka Viniyaman Avam Shulk Ka Nirdharan) Adhiniyam, 2007.”

The Committee is headed by a Chair Person alongwith four other experts in the matter of Finance, Law, Technical Education and Medical Education. Under provisions of the Act, AFRC is required to have general supervision and guidance of admission process and for fixation of fee to be charged from the candidates seeking admission in the private professional educational institutions. It also provides for appointment of an Appellate Authority.

Act 21 of  Adhiniyam, 2007.”  Chapter II, Section 11 reads as follows:

The Committee shall have the power to regulate its own procedure in all matters arising out of the discharge  of its functions and shall for the purposes of making any enquiry under this Act have all the powers of a civil court under the Code of Civil Procedure, 1908 (5 of 1908) while trying  a suit in respect of the following matters namely –

1. Summoning and enforcing the attendance of any witness and examining him on oath;
2. Requiring the discovery and production of any document;
3. Receiving evidence on affidavits;
4. Issuing commissions for  the  examinations of witness.

Act 21 of 2007 of Madhya Pradesh Niji Vyavsayik Shikshan Sanstha (Pravesh Ka Viniyaman Avam Shulk Ka Nirdharan) Adhiniyam, 2007, thereafter amendment No. 32 of 2013 dated 12 Sep. 2013 in section 4 of principal act, sub-section (9), reads: 

1. The Committee either on receipt of a complaint or suo motu may enquire into admission made in contravention of the provisions contained here under or collection of fee in excess of the fee determined under the provisions of the Act, or realization of capitation fee or profiteering by any private unaided professional education institution.
2. The committee may cause an inspection of the institution for the purpose of making enquiry under clause (a)
3. If as a result of the enquiry the Committee finds that there has been any violation by such institution of the provisions of the Act or rules and regulations made there under regarding admission or fees, it may take one or more of the following actions against such institution :-

1. impose a fine up to ten lac rupees on the institution together with interest therein at the rate of 12 percent per annum which may be recovered as if an arrear of land revenue.
2. declare any admission made in contravention of the provisions of the Act invalid, whereupon the institution shall forthwith cancel the admission of such candidate and the concerned university shall cancel the enrolment of such student and cancel his results of any examination in which the candidate has already appeared;
3. order the institution to refund to a student within such time as specified in the order, any amount received by it in excess of the fees fixed by the Committee or any amount received by way of capitation fee or any amount received for profiteering.

Amendment No. 32 of 2013 dated 12 Sep. 2013 in section 10 of principal act, sub-section (10), reads:

 10 (1) The State Government shall appoint for not more than three years at a time, an appellate authority, consisting of a person, who has been a judge of the High Court, or a person who has held office not below the rank of the Chief Secretary of a State, before which a person or a professional institution aggrieved by an order of the Committee may file an appeal, within a period of 30 days of passing of such an order,

 (2) While hearing an appeal the Appellate Authority after calling for the records from the Committee and after giving an opportunity of hearing to both the appellant and the Committee shall decide the appeal and the decision made in the appeal shall be final.

 At present AFRC is regulating  more than 2300 institutions of various courses  the details are given below:-

 Higher Education Institutions - 999 

 Medical & Paramedical Education Institutions - 74 

 Technical Education Institutions- 1312 

प्रवेश एवं फीस विनियामक समिति का गठन एवं कार्य

म.प्र. शासन विधि एवं विधायी कार्य विभाग, भोपाल द्वारा प्रकाद्गिात राजपत्र दिनांक 04 अगस्त 2007 के तहत मध्यप्रदेश निजी व्यावसायिक शिक्षण संस्था (प्रवेश का विनियमन एवं शुल्क का निर्धारण) अधिनियम-2007 तदोपरांत संद्गाोधित अधिनियम-2013 के तहत प्रवेश एवं फीस विनियामक समिति का गठन हुआ है।

अधिनियम-2007 के अध्याय-दो के तहत गठित की गई ''समिति की अध्यक्षता सभापति (चेयरपर्सन) द्वारा की जायेगी जो किसी केन्द्रीय विश्वविद्यालय या राज्य विश्वविद्यालय या विश्वविद्यालय समझी गई संस्था का कुलपति रहा हो या ऐसा वरिष्ठ प्रशासनिक अधकिारी रहा हो जो राज्य सरकार के प्रमुख सचिव या भारत सरकार के संयुक्त सचिव की पदश्रेणी से निम्न पदश्रेणी का न हो और इसके अंतर्गत चार अन्य सदस्य होंगे जिन्हें वित, प्रशासन या विधि, तकनीकी शिक्षा तथा चिकित्सा शिक्षा के मामलों में विशेषज्ञता हासिल हो।''

अधिनियम-2007 के अध्याय-दो की कंडिका(11) के अनुसार-

"समिति को, उसके कृत्यों के निर्वहन में उद्‌भुत होने वाले समस्त मामलों में अपनी स्वयं की प्रक्रिया विनियमित करने की शक्ति होगी और इस अधिनियम के अधीन कोई जांच करने के प्रयोजनों के लिए सिविल प्रक्रिया संहिता, 1908 (1908 का 5) के अधीन निम्नलिखित मामलों के संबंध में, जबकि वह किसी वाद का विचारण कर रही हो, सिविल न्यायालय की समस्त शक्तियां होंगी।''

मध्यप्रदेश निजी व्यावसायिक शिक्षण संस्था (प्रवेश का विनियमन एवं शुल्क का निर्धारण) अधिनियम-2007 तदोपरांत संशोधित अधिनियम-2013 धारा 4 मूल अधिनियम की धारा 4 में, उपधारा (9) की कंडिका :

• (क) समिति, सहायता न पाने वाले किसी निजी व्यावसायिक शिक्षण संसथा की, उसके द्वारा इसके अधीन अंतर्विष्ट उपबंधों के उल्लंघन में प्रवेश अथवा अधिनियम के उपबंधों के अधीन अवधारित किए गये शुल्क से अधिक शुल्क वसूल करने अथवा कैपीटेशन फीस प्राप्त करने अथवा मुनाफाखोरी करने के संबंध में, कोई शिकायत प्राप्त होने पर अथवा स्वप्रेरणा से जांच कर सकेगी।
• (ख) समिति, खण्ड (क) के अधीन जांच किए जाने के प्रयोजन से संस्था का निरीक्षण करवा सकेगीः परन्तु समिति, राज्य सरकार या संबंधित विश्वविद्यालय या समुचित प्राधिकारी के आदेद्गा पर, संबंधित विभाग द्वारा तैयार की गई किसी निरीक्षण रिपोर्ट का संज्ञान ले सकेगी।
• (ग) यदि जांच के परिणामस्वरूप समिति यह पाती है कि ऐसी संस्था द्वारा प्रवेद्गा अथवा फीस के संबंध में इस अधिनियम या उसके अधीन बनाए गए नियमों तथा विनियमों के उपबंधों का कोई उल्लंघन हुआ है, तो वह ऐसी संस्था के विरूद्ध निम्न से एक या अधिक कारवाईयां कर सकेगी :-
• (एक) संस्था पर दस लाख रूपये तक का जुर्माना उस पर 12 प्रतिद्गात वार्षिक की दर से ब्याज सहित अधिरोपित कर सकेगी जो इस प्रकार वसूल किया जा सकेगा मानो कि वह भू-राजस्व का बकाया हो।
• (दो) अधिनियम के उपबंधों के उल्लंघन में दिये गये किसी प्रवेश को अवैध घोषित कर सकेगी, जिस पर संस्था ऐसे अभ्यर्थी का प्रवेश तुरन्त निरस्त कर देगी और संबंधित विश्वविद्यालय ऐसे छात्र का नामांकन निरस्त कर देगा और किसी ऐसी परीक्षा के उसके परिणाम को निरस्त कर देगा जिसमें कि अभ्यर्थी पूर्व में ही सम्मिलित हो चुका है।
• (तीन) संस्था को, किसी छात्र को, ऐसे समय के भीतर, जो कि आदेश में विनिर्दिष्ट किया गया हो, समिति द्वारा निर्धारित फीस से अधिक प्राप्त की गई कोई राद्गिा अथवा कैपिटेशन फीस के रूप में प्राप्त की गई कोई राद्गिा या मुनाफे के लिये प्राप्त की गई कोई राशि वापस करने का आदेश दे सकेगी। परन्तु यदि संस्था छात्र को, विनिर्दिष्ट समय के भीतर राशि वापस करने में असफल रहती है तो वह, उस पर 12 प्रतिशत वार्षिक की दर से ब्याज सहित, भू-राजस्व के बकाया के तौर पर वसूल किये जाने योग्य होगी और छात्र को संदत्त की जायेगी।
• (चार) संस्था को, ऐसी कालावधि के लिये, जैसी कि वह उचित समझे, किसी व्यावसायिक पाठ्‌यक्रम में प्रवेद्गा रोकने या स्वीकृत अन्तर्ग्रहण को कम करने का आदेश दे सकेगी।
• (पांच) विश्वविद्यालय अथवा संबंधित समुचित प्राधिकारी से संस्था की मान्यता वापस लेने की सिफारिश कर सकेगी।
• (छह) ऐसी कोई अन्य कार्रवाई कर सकेगी जैसी कि वह उचित समझे।

5. मूल अधिनियम की धारा 10 के स्थान पर, निम्नलिखित धारा स्थापित की जाए, अर्थात्‌:-

• 10 (1) राज्य सरकार, एक बार में तीन से अनधिक वर्ष के लिये, एक अपील प्राधिकारी की नियुक्ति करेगी जो ऐसा व्यक्ति होगा जो उच्च न्यायालय का न्यायाधीश रह चुका हो या जो राज्य के मुख्य सचिव की पदश्रेणी से अनिम्न पदश्रेणी का पद धारण कर चुका हो, जिसके समक्ष समिति के किसी आदेश से व्यथित कोई व्यक्ति अथवा कोई व्यावसायिक संस्था, ऐसा आदेश पारित किए जाने से 30 दिन की कालावधि के भीतर अपील प्रस्तुत कर सकेगी।
• (2) किसी अपील की सुनवाई के दौरान अपील प्राधिकारी, समिति से अभिलेख मंगाने के पश्चात्‌ तथा अपीलार्थी एवं समिति दोनों को सुनवाई का अवसर देने के पश्चात्‌ अपील का विनिश्चय करेगा और अपील में किया गया विनिश्चय अंतिम होगा।

वर्तमान में एक्ट में दिये गये प्रावधानों के अनुसार निजी क्षेत्र की गैर अनुदान प्राप्त शिक्षण संस्थाओं में संचालित पाठ्‌यक्रमों के  फीस का निर्धारण किया जा रहा है, जिनका विवरण निम्नानुसार है : -

उच्च शिक्षण संस्थान- 999

चिकित्सा शिक्षण संस्थान-74
